“SPECIALIZED COURT: CHILDREN’S RIGHT AND FAMILY”

International Conference

OVERVIEW

Background:

Countries have been establishing juvenile and family courts for many years. These courts recognize that minors who commit crimes or violations, or who are otherwise involved in judicial proceedings, require a supportive environment and special legal procedures that are appropriate for their age, physical, and psychological characteristics. This approach emphasizes the importance of considering their further development as individuals. In this way, countries like Australia, certain states in the United States, Germany, Canada, the Republic of Korea, New Zealand, India, Japan, and Belgium have established family courts. In contrast, countries like England, Austria, Hong Kong, and Taiwan have integrated family chambers within their court systems.[1]

In recent years, there has been a noticeable increase in the number of divorce and alimony cases processed through the judicial system in Mongolia. Family Law matters account for approximately 10-12 percent of all first-instance civil litigation. Hence, the Mongolian State Great Khural enacted a revised version of the Law on the Establishment of Courts and related procedural legislation on June 5, 2024. According to the provisions outlined in the newly amended law, the Family and Children’s Court of First-instance and the Court of Appeal will be established on January 1, 2026.

At this international conference, in conjunction with the establishment of the Family and Children’s Court in Mongolia, scholars and judges from Mongolia and Germany, as well as Japan and Korean, Netherlands, Türkiye, United States who have experience in this type of court, will present a speech and exchange experiences under the general topic “Specialized court: Children’s right and family”.

Objective:

The invited speakers will share the positive experience of a nation that has developed a specialized system for handling these kinds of cases to safeguard the interests of families and children and guarantee a fair, efficient, and successful case implementation. The goal of this will be to set the stage for the creation of a suitable system to address urgent problems.

Thus, scientists, researchers, and judges from home and abroad will give various lectures and discussions on the theoretical and practical experience of other countries under the general theme of " Specialized court: Children’s right and family ".

Topic:

The conference’s overarching theme is ‘Specialized court: Children’s right and family’. Speakers will present the following crucial topics necessary to fully define the challenges in protecting family and children’s rights: the jurisdiction of the courts that handle these matters, as well as the courts' processes and organizational frameworks.

  • Family and Cohabitation: Issues related to Adoption, Divorce, Maternal and Infant Welfare, Child Custody, and Shared Property Relations;
  • Procedural Framework for Juvenile Cases;
  • Family and Juvenile Court Procedures, Structure, and Organization.

Conference outcome:

The upcoming conference will feature a series of presentations by eminent scientists, researchers and judges with expertise in this field. Each lecture will be followed by a discussion on the main topics covered. The focus of the conference will be on the structural organization and scope of jurisdiction of Family and Children's Courts, as well as the consideration of appropriate alternatives for case management based on best practices from other countries.
